1. Acceptance of Terms

By downloading, installing, or using the Celestia mobile application ("App") or visiting our website at celestia-astro.app ("Website"), you agree to be bound by these Terms of Use ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the App or Website. These Terms constitute a legally binding agreement between you and Celestia Astro ("Celestia," "we," "us," or "our").

2. Description of Service

Celestia is an astrology application that provides AI-generated horoscopes, natal birth chart analysis, planetary transit tracking, moon phase information and rituals, compatibility (synastry) analysis, cosmic daily tips, and related astrological content. The App is available for iOS devices (iPhone and iPad) running iOS 17.0 or later. Certain features require an active internet connection.

3. Entertainment Purposes — Important Disclaimer

All astrological content, readings, horoscopes, AI-generated interpretations, and related materials provided through the App are strictly for entertainment and informational purposes only. Celestia does not provide professional advice of any kind, including but not limited to medical, psychological, psychiatric, financial, legal, or relationship advice. You should not rely on astrological content to make important life, health, or financial decisions. If you need professional guidance, please consult a qualified professional in the relevant field.

4. Eligibility

You must be at least 13 years of age (or 16 in the European Economic Area) to use the App. If you are between 13 and 18 years of age (or the age of legal majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the App, you represent and warrant that you meet these eligibility requirements.

5. User Data & Privacy

Certain features of the App require you to provide personal information such as your name, birth date, birth time, and birth location. This information is stored locally on your device. You are responsible for the accuracy of information you provide. Our collection and use of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

6. Subscriptions and Payments

Celestia offers a free tier and optional premium subscription plans ("Celestia+") that provide access to additional features.

Available Plans:

• Celestia+ Monthly: $4.99 per month
• Celestia+ Yearly: $29.99 per year

Subscription Terms:

• Payment will be charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.
• You can manage and cancel your subscriptions by going to your Account Settings in the App Store after purchase (Settings → Apple ID → Subscriptions).
• Any unused portion of a free trial period, if offered, will be forfeited when you purchase a paid subscription to Celestia+.
• Prices are in USD and may vary by region. Prices may be updated from time to time; any price changes will apply to the next billing cycle after the change.

Free Tier Includes: Daily horoscope, basic birth chart, moon phase tracking, transit list, and basic cosmic tips.

Celestia+ Includes: Everything in Free, plus weekly & monthly horoscopes, detailed transit interpretations with action steps, full synastry compatibility analysis, personalized moon rituals & journal prompts, extended cosmic do's & don'ts, and an ad-free experience.

7. Refunds

All purchases and subscriptions are processed through Apple's App Store. Celestia does not process payments or refunds directly. To request a refund, you must contact Apple directly through their standard refund process at reportaproblem.apple.com or through Apple Support, in accordance with Apple's refund policies.

8. Intellectual Property

All content, features, and functionality of the App and Website — including but not limited to text, graphics, logos, icons, images, audio, video, software, algorithms, UI design, and the overall design and look-and-feel — are owned by Celestia Astro or its licensors and are protected by copyright, trademark, trade secret, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content without our prior written consent.

9. AI-Generated Content

The App uses artificial intelligence (powered by Cloudflare Workers AI) to generate personalized astrological content. You acknowledge and agree that:

• AI-generated content is produced algorithmically based on your birth chart data and current planetary positions.
• AI-generated content may occasionally contain inaccuracies, inconsistencies, or errors.
• We do not guarantee the accuracy, completeness, or reliability of any AI-generated content.
• AI-generated readings should be treated as entertainment and not as factual statements or professional advice.
• You assume all risk associated with your reliance on AI-generated content.

10. Prohibited Conduct

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms.
• Attempt to reverse-engineer, decompile, disassemble, or derive the source code of any part of the App.
• Interfere with or disrupt the App's servers, networks, or infrastructure.
• Scrape, data-mine, or otherwise extract content from the App using automated means (bots, spiders, crawlers).
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Redistribute, sublicense, or resell access to the App or any content generated by it.
• Use the App to generate content that is harmful, abusive, or violates any third party's rights.

11. Disclaimer of Warranties

THE APP AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE MAKE NO WARRANTY REGARDING THE ACCURACY OF ASTROLOGICAL INFORMATION OR AI-GENERATED CONTENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CELESTIA ASTRO AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) FIFTY US DOLLARS ($50).

13. Indemnification

You agree to indemnify, defend, and hold harmless Celestia Astro and its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or related to: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your violation of any third party's rights.

14. Apple-Specific Terms

The following terms apply to your use of the App as downloaded from Apple's App Store:

• Acknowledgment: These Terms are between you and Celestia Astro only, and not with Apple Inc. ("Apple"). Celestia Astro, not Apple, is solely responsible for the App and its content.
• Scope of License: The license granted to you for the App is limited to a non-transferable license to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules set forth in the App Store Terms of Service.
• Maintenance and Support: Celestia Astro is solely responsible for providing any maintenance and support services with respect to the App. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
• Warranty: In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any, for the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App.
• Product Claims: Celestia Astro, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.
• Intellectual Property Claims: In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Celestia Astro, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
• Third-Party Beneficiary: You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
• Legal Compliance: You represent and warrant that (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date above and, where appropriate, through an in-App notification. Your continued use of the App after material changes constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the App.

16. Termination

We may suspend or terminate your access to the App at our sole discretion, without prior notice, for conduct that we believe violates these Terms, is harmful to other users, us, third parties, or for any other reason. Upon termination, your right to use the App will immediately cease. Sections 3, 8, 9, 11, 12, 13, 14, 18, and 19 shall survive any termination of these Terms.

17. Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the App shall first be attempted to be resolved through informal negotiation by contacting us at support@celestia-astro.app. If informal resolution fails within 30 days, either party may pursue resolution through binding arbitration or small claims court at the election of the claimant, except that either party retains the right to seek injunctive or equitable relief in a court of competent jurisdiction. You agree that any arbitration or court proceeding shall be conducted on an individual basis and not as a class action.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions. Any legal proceedings shall be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.

19. General Provisions

• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Celestia Astro regarding the App and supersede all prior agreements and understandings.
• Severability: If any provision of these Terms is held to be invalid or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall continue in full force and effect.
• Waiver: The failure of Celestia Astro to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
• Assignment: You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
• Force Majeure: We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, acts of government, internet or infrastructure failures, or pandemics.
